Terms and Conditions: New Website Deal 2026
- The Offer and Scope of Services The “New Website Deal 2026” provides a professional business website (5–8 pages) for a fixed fee of £70 per month.
- Included Features: UI/UX design for mobile and tablet compatibility, SEO-ready structure, one domain name, SSL certificate, professional hosting, and five branded email accounts (10GB storage each).
- Exclusions: Any services not explicitly listed (e.g., extra pages or advanced features) are considered outside the agreement and will be charged separately at prevailing ad-hoc rates.
- Contract Term and Mandatory Commitment
- Minimum Term: This is a legally binding 18-month fixed-term contract.
- 30-Day Grace Period: You may cancel the agreement within the first 30 days of the start date by providing written notice. If cancelled, the website/hosting will be removed, and no ownership rights transfer.
- Irrevocability: After 30 days, the contract is irrevocable. You may not terminate for convenience, and all fees for the full 18 months are contractually due.
- Payment Terms and Late Fees
- Payment Schedule: Monthly payments of £70 are due via Bank Transfer or Direct Debit on the 1st of each month.
- Invoicing: Invoices are due within 14 days of issue.
- Late Payments: Payments not received within 30 days may result in immediate contract termination. Late payments are subject to statutory interest at 8% above the Bank of England base rate.
- Project Delivery Timelines
- Design Concept: Delivered within 30 days of the project start, contingent on the Agency receiving all requested materials and content from the client.
- Final Completion: The final website will be completed within 90 days of the client’s formal approval of the design concept, subject to timely feedback.
- Maintenance and Service Levels (SLA)
- Included Maintenance: WordPress core, plugin, theme, and PHP updates, plus security patches and backend maintenance. Includes up to five (5) monthly content updates to existing pages.
- Standard Requests: Acknowledged within 24–48 working hours; completed within 3–5 working days.
- Critical Issues: For website outages or security breaches, the Agency will begin addressing the issue within 4 hours of notification.
- Ownership and Intellectual Property (IP)
- Transfer of Rights: Full ownership and IP rights of the website vest in the client only after all 18 monthly payments (and any additional charges) have been completed in full.
- Interim Ownership: The Agency retains full ownership and all rights until final payment.
- Hosting and Post-Contract Options
- Mandatory Hosting: Website hosting must remain under the Agency’s control for the full 18-month term. Early transfer is not permitted.
- End of Term: After 18 months, you may:
- Transfer the website to a provider of your choice (the Agency will provide reasonable cooperation).
- Continue hosting with the Agency under a new written arrangement.
- Early Termination and Liquidated Damages If you purport to terminate the contract after the 30-day grace period but before the 18-month completion, all remaining fees for the remainder of the term become immediately due and payable as liquidated damages representing the Agency’s anticipated loss.
- Liability and Data Protection
- Liability Cap: The Agency’s total liability is limited to the fees paid by the client in the 12 months preceding a claim.
- Force Majeure: Neither party is liable for failures caused by events outside their control (e.g., internet/power failure, pandemics, acts of God).
- GDPR: Both parties will comply with the UK GDPR and Data Protection Act 2018.
- Post-Termination Transition Upon termination (after the 18-month term), the Agency will leave the website in its current state for a 14-day transition period to allow for file migration before services are permanently removed.
- Governing Law This agreement is governed by the laws of England and Wales
